14.6 Workforce Reductions (Layoffs)

The City Manager may lay off employee(s) when it is deemed necessary by reasons of shortage of funds or work, the abolition of the position, or other material changes in the duties of the position, the best interest of the organization, or for other related reasons. Such workforce reduction will not reflect discredit upon the service of employees. The duties performed by any employee who has been laid off may be reassigned to other employees.

Order of Layoff

When it becomes necessary to reduce the number of employees within a given class in any department due to lack of funds, work, or other reasons, employees shall be laid off as follows:

  1. On-call and temporary employees
  2. Probationary employees (new-hires)
  3. Regular part-time and full-time employees

When the need arises for laying off an employee serving in a transfer or promotional probationary period, the employee shall be returned to a position of the class from which he was promoted or transferred if a vacancy exists. In determining layoff, the City will comply with Veterans’ Preference guidelines and also consider the employee’s performance and then length of service in the job classification within the department and other federal requirements which may apply.

An employee who is laid off from a position and rehired within 12 months will be considered reinstated. This employee will be credited with all unused sick leave and any other benefits related to City or Departmental seniority/time in service that had been accumulated at the time of layoff.
